According to Texas law, a surviving parent can designate—through a will or written declaration—guardians of the minor children and their estate. Guardians will decide your children’s health, education, and moral upbringing.

Once the legal guardian has been selected, name the person in either your will or your living trust. The court will appoint the guardian you designate, as long as he/she is willing, qualified, and the decision is in the best interests of the children.
