Does it matter who files for divorce first?

There is no advantage to filing for divorce (being the petitioner) or receiving the divorce papers (being the respondent). In a divorce case, the court is concerned about the divorce proceeding going fairly and based on the law. Who initially filed is not important in this regard.

How long does the divorce process take?

In Texas, a divorce can’t be finalized until at least 60 days have passed since the petition was filed. For this reason, a divorce will take at least two months. However, a two-month divorce would be very fast. Most divorces can take six months, a year, or longer, even if they are uncontested.

How much does it cost to file for divorce in Texas?

The filing court filing fees for a divorce in Texas usually cost about $300. The total cost of getting a divorce will be larger, though, as miscellaneous costs are factored in.
